What is IMNSHO's Copyright Policy?

 

How does IMNSHO treat copyrighted information?
First things first.  Except as otherwise noted, all material located at this Website Copyright 2000 -2008 by IMNSHO.com.  IMNSHO is the opinion site of Front Room Enterprises, a freelance writing and website content business in Cedar Park, TX. You can find a copy of our Doing Business As (DBA) statements filed at the Williamson County Courthouse, Georgetown, TX.

 

OK, let's try this again.  How does IMNSHO treat copyrighted information?
IMNSHO is based in the United States of America, and its activities are governed under U.S. law.  We fully support everyone's right to have their original works protected fully under the Copyright Act (title 17, U.S. Code).  IMNSHO also takes advantage of the fair use provisions of the Copyright Act governing parody and satire for the entertainment of its patrons and visitors.  If you believe there are copyrighted works at this site that are not fair use or for which proper attribution is not provided, please notify us immediately.  IMNSHO will always try to "otherwise note" all works that are not original.  IMNSHO will usually provide an HTML link to the source if that is appropriate.  IMNSHO cannot be responsible for that HTML or Web link being changed after the fact.  Such dead links, also known as Cobweb Links, are not the responsibility of IMNSHO. 

However, back to the subject at hand.  The Webmaster at IMNSHO is the original author of most content at this site.  IMNSHO uses graphics that are purported to be in the public domain or which may be used royalty free on the Internet from purchased collections sold by IMSI (MasterClips) or other such companies.  Other graphics have been obtained from a Lycos multimedia search at www.lycos.com.  From our understanding by reading the Lycos policy, these graphics have been submitted to Lycos, and under their policy, Lycos may use these graphics royalty-free.  IMNSHO obtained these graphics from the Lycos site with the understanding that they were provided royalty-free by Lycos.  IMNSHO has subsequently reconsidered paragraph 21 of the Lycos policy.  This Lycos paragraph in Lycos policy contradicts the general statement earlier in its policy.  Paragraph 21 states that Lycos does not have the right to grant permission to reproduce such pictures.  Well, that's a drag. IMNSHO has used some (three as we recall) pictures from this Lycos search facility, but has been unable to locate the original owner of those pictures.  IMNSHO asks that, if you are the copyright holder of these pictures (of hamsters), that you contact IMNSHO as described below so that you may receive credit for these pictures or so that you may ask that they be removed from this site (under which circumstances IMNSHO will comply).  All fonts used at this site are believed to be in the public domain.  Like anything else, if a visitor feels otherwise, contact the Webmaster.

 

Is everything at IMNSHO an original work?
Heck no, aren't you paying attention?  IMNSHO derives much of its humor from satire and parody.  Section 107 of the Copyright Act covers parody and fair use (see Fair Use link at right).  No reader will mistake any IMNSHO parody for the original work.  IMNSHO attempts to poke fun at the original work (and life in general, and live on Usenet specifically) and entertain its audience.  IMNSHO will attempt to give credit to all original authors and copyright holders when known.  IMNSHO encourages all readers, listeners and visitors to obtain the original works by the original authors so that they may profit from any IMNSHO parody of their creations.

 

Aren't you stealing original material for your own profit when you create a parody?
Heck no, if anything, IMNSHO is flattering the original author by choosing it for parody (although the person who created the original work may not feel flattered).  If IMNSHO opinion can identify the original author, we will give full credit.  As far as stealing is concerned, that implies that IMNSHO will profit from these works, and for musical parodies found here, that is not the case.  At most, the parodies at this site might influence a visitor to return and visit other areas on this site that might earn some profit for IMNSHO.  IMNSHO does not use any specific method for deriving profit from any parody.  Original authors of parodied works are not being denied any profit from their work to the specific advantage of IMNSHO.  At most, the parody may add to the overall value of a visitor's experience at IMNSHO.

 

I don't like your parody, and I want you to remove it from your site
Then I strongly suggest you email us (see contact information at the bottom of this page).  We may tell you to blow it out your ear (or we may be in a better mood that day).  If you do not like being the butt of one of our parodies, tough.  If, however, you are claiming infringement of your original work or as an agent of the copyright holder, please provide the following information to secure your rights under the Digital Millennium Copyright Act (DMCA - see copyright links at leftt).  This information should be sent to IMNSHO.com and to our Web Hosting Service (our Online Service Provider, or OSP, as defined by the DMCA - see contact information below).  You must provide, at minimum, the following information which is required by the DMCA and by our OSP (whose policy is found at under the OSP Policy link and whose requirements are quoted or paraphrased below):
the identity of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by the DMCA, a representative list of the copyrighted works that you claim have been infringed using our OSP's service,
identification of the material that you claim is infringing, and
your street or mailing address, telephone number, and, if available, email address.
You must state that you have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g. fair use).
You must state that the information you provide is accurate and, under penalty of perjury, that you are the copyright owner, or authorized to act on behalf of the owner of the copyright or of any exclusive right under the copyright.
You must also provide an electronic or physical signature of the copyright owner or of a person authorized to act on behalf of the owner of the copyright or of any exclusive right under the copyright.

 

What the heck does all that legal gobbledygook mean?
The Copyright Act protects original authors and artists.  The DMCA protects Online Service Providers by limiting their liability in certain precise ways.  If OSPs provide web hosting services for someone who infringes a copyrighted work, the OSP can't be hammered if they follow provisions of the DMCA.  An OSP must publish a policy.  This policy must tell copyright holders how to properly notify them of an infringement.  If the infringement notice is valid, the OSP must serve their subscriber with a "Notice and Take Down".  The infringing material must be removed.  The OSP can prevent access to the copyrighted material.  The subscriber can disagree and provide a "counter notice" attesting to the legality of the material.  Under "Notice and Put Back" provisions of the DMCA the OSP must in turn notify the copyright holder and promptly restore the material.  Then the whole thing must go to court for any continuation of the fight.

If anybody provides false information during this process they can be liable for damages and attorney fees. I think that is a great concept. Right, all you UFFers out there?

 

Can I use material from IMNSHO on my site?
I would prefer that you use a link from your site to mine.  If you do use material under the Fair Use provisions of the copyright act, please give proper attribution and credit at your site.

Otherwise, I'm coming after you.

If I may be serious for one brief moment, I will exercise my rights under the copyright act vigorously if I find you using my original work, especially if you claim it to be your own.  I would expect you to do the same.
